By accessing or using the "What Would Jim Say" service (the "Service"), you agree to be bound by these Terms of Use. If you do not agree, you may not use the Service.

2. Description of Service

The Service is an experimental artificial intelligence tool provided by James Farrelly, an individual residing in Pennsylvania, USA. It is not a commercial corporate entity.

3. User Conduct and Prompts

You are solely responsible for the content of the prompts you submit. You agree NOT to use the Service to:

  • Submit prompts that are unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable.
  • Generate content that violates the intellectual property or privacy rights of others.
  • Attempt to exploit, manipulate, or degrade the Service.

4. License to Prompts and Outputs

By submitting a prompt, you grant me a non-exclusive, worldwide, royalty-free license to use, store, review, and analyze your prompts for the purpose of operating, monitoring, and improving the Service. You acknowledge that AI-generated outputs may not be unique across different users and that the outputs are provided without any guarantee of copyrightability or factual accuracy.

5. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. I disclaim all warranties, express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. I do not guarantee that the Service will be uninterrupted, error-free, or factually accurate.

6. Limitation of Liability

To the maximum extent permitted by law, in no event shall James Farrelly be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the Service; (b) any conduct or content of any third party on the Service; or (c) any unauthorized access, use or alteration of your transmissions or content.

7. Indemnification

You agree to defend, indemnify, and hold harmless James Farrelly from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees arising out of or relating to your violation of these Terms of Use or your use of the Service.

8. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Commonwealth of Pennsylvania, USA, without regard to its conflict of law provisions.
